Jesh Production – Terms & Conditions

These Terms & Conditions ("Terms") apply to all services provided by Jesh Production to any individual or entity (“Client”). By engaging Jesh Production’s services, including but not limited to accepting a quote, proposal, or invoice, or by commencing a project, the Client acknowledges that they have read, understood, and agree to be bound by these Terms. If the Client is engaging services on behalf of an organization, they represent that they have the authority to bind that organization to these Terms.
1. Scope of Services
- A. Jesh Production provides audiovisual services, including video production, photography, and related creative services.
- B. Specific project details, deliverables, and timelines are communicated via email, text, quotes, proposals, or invoices.
- C. Final selection and editing is directed by the producer.
- D. Not raw (unedited) photos or videos will be giving.
- E. Services not explicitly included in a project agreement may incur additional fees.
2. Copyright & Usage
- A. Jesh Production retains full copyright and ownership of all creative works unless otherwise agreed in writing.
- B. Upon full payment, the client is granted a non-exclusive, perpetual license to use the delivered content for its original intended purpose.
- C. Any resale, sublicensing, redistribution, or modification of the deliverables beyond the agreed scope requires prior written authorization from Jesh Production.
- D. Any deliverables containing Jesh Production’s logo or branding must retain the logo and may not be removed or altered without prior written consent.
- E. Any deliverables may not be used for any illegal, unethical, or immoral purposes. Any use of the deliverables that violates laws or moral standards is strictly prohibited and may result in termination of the license.
3. Payment Terms
- A. Project fees are outlined in the invoice or proposal.
- B. A deposit may be required to confirm project booking.
- C. Late payments may incur fees at the discretion of Jesh Production.
4. Revisions & Changes
- A. Additional revisions or changes may incur extra charges.
5. Cancellation & Refunds
- A. Deposits are non-refundable.
- B. If the Client cancels after work has started, fees for completed work may be due at the discretion of Jesh Production.
- C. Refunds or adjustments are at the discretion of Jesh Production and may consider completed work, expenses, or services offered.
6. Liability & Risk
- A. Clients assume responsibility for personal injury, property loss, or damage occurring during a project.
- B. Jesh Production exercises reasonable care but is not liable for any injury, theft, or damage to persons or property during the project.
- C. The Client agrees to indemnify, defend, and hold Jesh Production harmless from any claims, liabilities, damages, or expenses arising from participation in the project.
- D. The Client is liable for any damage to Jesh Production's team members, equipment or property caused by the Client's negligence or misuse.
7. Dispute Resolution & Governing Law
- A. Any disputes arising from these Terms will first be attempted to be resolved through good-faith negotiation.
- B. These Terms are governed by the laws of Nevada. Any legal action must be brought in the courts of Las Vegas, Nevada.
8. Values & Professionalism
- A. Jesh Production is committed to operating with integrity, excellence, and respect. We expect the Client to engage in good faith, including timely communication, adherence to schedules, and respectful conduct toward our team.
- B. Any breach of professionalism (e.g., harassment, disrespect) may result in immediate project termination without refund and the responsibility of payment for any services offered.
9. Confidentiality
- A. The client agree to treat any information shared during the project (e.g., production ideas, business details and techniques) as confidential and not disclose it to third parties without written consent. This obligation survives project completion, indefinitely.
10. Terms & Conditions Updates
- A. These Terms may be updated from time to time. The most current version will be posted on our website at [www.jeshproduction.com/#terms] (or equivalent URL). Continued use of our services after any updates constitutes acceptance of the revised Terms.
